JUSTICE BIRENDRA KUMAR ORAL ORDER 20-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 399/402/414/412 of the Indian Penal Code and Sections 25(1-b)A/26/35 of the Arms Act. On suspicion six persons were apprehended by the police while they were traveling on vehicle. Suspicion is that they were making preparation to commit dacoity. Only a mobile phone was recovered from the possession of the petitioner. Firearm was recovered from other co-accused. Co-accused Nityanand Singh, from whose possession fire-arm was recovered has already been allowed bail by this Court in Cr. Misc. No. 35338 of 2016 on 19.10.2016.

No.48158 of 2016 (2) dt.20-12-2016 2/2 Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara/Successor Court, in connection with Udwantnagar P.S. Case No. 213 of 2016.
