JUSTICE SUDHIR SINGH ORAL ORDER 23-11-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 13.03.2015 in connection with Rafiganj P.S. Case No. 33 of 2015 for the offences instituted under Sections 452, 341, 324, 326 and 307 of the IPC.
The prosecution story, in brief, is that on 10.03.2015 at about 7.00 P.M., the informant was in her house, all of a sudden, Sunil Paswan the petitioner entered into her house and attempted to caught her and poured kerosene oil on her face and lit fire on match and throw on her and she was burning and the petitioner fled away and she made cry, the witnesses came and any how rescued her and brought her at Rafiganj Hospital.
Patna High Court Cr.Misc. No.36760 of 2015 (3) dt.23-11-2015 2/2 It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 13.03.2015 and the charge sheet has been submitted in the case. There is no allegation of tampering of the evidence against the petitioner. The petitioner has falsely been implicated in the present case. From perusal of the case diary it would appear that till date opinion of the doctor has not been reserved in respect to the injury sustained by the victim. It is further submitted that the petitioner may be released on bail after completion of nine months in custody from 13.03.2015. .
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named may be released on bail after completion of nine months in custody from 13.03.2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad in connection with Rafiganj P.S. Case No. 33 of 2015.
