This application for anticipatory bail arises out of Muzaffarpur Excise Case No. 262 of 2021 for the offence punishable under Sections 30(A) and 32(3) of the Bihar Prohibition and Excise Act, 2016.

It is submitted by the learned counsel for the petitioner that he had given his land on rent vide Annexure-2 and he has falsely been implicated in this case due to village party politics.

Considering the above submission, this application is allowed till submission of charge sheet.

Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below

Patna High Court CR. MISC. No.69001 of 2021(2) dt.24-12-2021 2/2 be released on bail on furnishing bail bond of Rs. 10,000 (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Muzaffarpur in connection with Muzaffarpur Excise Case No. 262 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, with a condition that after being released on bail the petitioner shall join investigation and the Investigating Officer will investigate the contention of the petitioner that he has given his land on rent, if the contention is found true petitioner shall release on bail and if the contention is found false his bail bond shall be cancelled after submission of charge sheet.
