JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report and informant specifically stated that three persons in inebriated condition entered her house and attacked on her husband as a result thereof, her husband sustained injury and thereafter, he was taken to hospital. Admittedly, the injured died in course of his treatment and the name of petitioner came in further statement of informant.

It is pertinent to note here that the alleged occurrence took place on 01.01.2015 and the informant gave written report on 04.01.2015 but even after three days of the alleged occurrence she did not disclose the name of the petitioner.

Patna High Court Cr.Misc. No.37686 of 2015 (2) dt.04-09-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas at Sasaram in connection with Dehri S.C./S.T. P.S. Case No. 01 of 2015.
