====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 13-03-2023 Heard learned counsel for the petitioner and learned Special Public Prosecutor for the State.

Petitioner seeks bail in a case registered for the offence punishable under Sections 377 of the Indian Penal Code, Section 4/6 of POCSO Act and Sections 3(2)(va) SC/ST Act.

According to prosecution case, there is allegation against the petitioner of committing unnatural sex with the informant.

Learned counsel for the petitioner submits that the petitioner has clean antecedent and he has falsely been implicated in the present case. He further submits that no such occurrence has taken place as alleged in the F.I.R. Learned Special Public Prosecutor for the State on the

Patna High Court CR. MISC. No.56995 of 2022(4) dt.13-03-2023 2/2 other hand vehemently opposed the prayer for bail of the petitioner and submits that it has come during investigation that the petitioner has committed the crime as alleged in the F.I.R. Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail in connection with Wazirganj P.S. Case No. 229/2022, pending in the court of learned Special Judge POCSO-cum-ADJ-VI, Gaya.

Prayer is refused.
