The present application has been filed for modification of the order dated 25.03.2014 passed in Criminal Miscellaneous No.4460 of 2014 in connection with Complaint Case No.268 of 2012, pending before the learned SDJM, Nawada to the extent that the petitioner may be allowed not to make payment of Rs.2500/- per month to the complainant- opposite party no.2 by way of interim maintenance as directed by this court while granting anticipatory bail to the petitioner since the trial has concluded and the petitioner has been acquitted. It is needless to say that the order passed in Criminal Miscellaneous No.4460 of 2014 was subject to any order passed by the competent court. The relevant portion of the order reads as

Patna High Court Cr.Misc. No.38379 of 2015 (2) dt.24-09-2015 2/2 follows :- "Submission is that petitioner intends to resume and continue the matrimonial relationship with the complainant opposite party no.2, who is his one and only wife. To further, strengthen his intention and offer is being made to pay a sum of Rs.2500/- (two thousand five hundred only) per month to the complainant opposite party no.2 by way of interim maintenance, subject to any order on the point by the competent court."

Accordingly, the modification application is disposed of.
