JUSTICE SUDHIR SINGH ORAL JUDGMENT (Per: HONOURABLE THE ACTING CHIEF JUSTICE) Date: 25-01-2017 The grievance of the petitioner is that his son Shyam Narayan @ Sikku was brutally assaulted by the local police of Kishanganj as well as Boarder Security Force on 01.07.2015 while his son was participating in the physical test at B.S.F. camp, Kisanganj for selection to the post of constable (G.D.). The first information report was lodged by the petitioner on 06.07.2015 (Annexure-7) but still no action is being taken by the police. In the supplementary counter affidavit filed by the

Patna High Court CWJC No.12190 of 2015 dt.25-01-2017 2/2 Superintendent of Police, Kishanganj, it has been stated that in the investigations conducted, following six persons have been found involved in the occurrence in question as per the evidence collected by the Investigating Officer.

Keeping in view the averments made in the supplementary counter affidavit, we find that continuous monitoring of the investigation is not feasible or desirable. However, we hope that the Investigating Officer will take appropriate action and submit a report under Section 173 of the Code of Criminal Procedure in accordance with law expeditiously, preferably within six months.
