The petitioner is apprehending his arrest in a case registered under Sections 147, 148, 149, 341, 323, 325, 307, 504, 506 of the Indian Penal Code and 27 of the Arms Act. The prosecution allegation, in short, is that while the informant was sitting at his door, the accused persons, variously armed, came and started abusing the informant and on protest, he was assaulted by them. The persons came in rescue were also assaulted by the accused persons.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the

Patna High Court CR. MISC. No.55856 of 2019(3) dt.04-12-2019 2/2 present case. The petitioner is an old aged person having 73 years age. There is a land dispute between the parties for which a proceeding under section 144 Cr.P.C. is pending in the Court of S.D.O. Nalanda. The informant has given an undertaking that he will remove his gumti and the bamboo which he has put on the land in question. The entire occurrence has taken place for the said reason.

Considering the aforesaid facts and circumstances and the fact that the petitioner is an old aged person, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VI, Nalanda at Biharsharif in connection with Asthawan P.S. Case No. 133/2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
