JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-04-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 385, 379 of the Indian Penal Code and u/s 16, 17 of UAP Act.

Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has come in this case during the course of investigation in the confessional statement of co-accused. No incriminating article has been recovered from the possession of the petitioner and till date the petitioner has not been put on Test Identification Parade. Petitioner is in custody since 29.08.2019 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail and submits that petitioner has got criminal

Patna High Court CR. MISC. No.68706 of 2021(4) dt.25-04-2022 2/2 antecedent and 12 cases of similar nature are pending against him and during the course of investigation it has come that none of the witnesses were ready to disclose their names because this petitioner is dreaded criminal and charge has already been framed in this case on 06.11.2020.

Considering the nature of accusation, gravity of the offence and progress of the trial, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. However, since the petitioner is in custody since 29.08.2019, the trial court is directed to conclude the trial as early as possible.
