The petitioner seeks bail in a case registered for the offence punishable under Sections 18(b) of Narcotic Drugs and Psychotropic Substance Act.
FIR was lodged against three accused that they had grown opium in their field. During investigation, the name of the petitioner has appeared alleged to have also grown opium in the field.
It is submitted that the petitioner has no concern with the land except that he is a relative of one of the accused Smt. Sunaina Devi. It is further submitted that in similar facts and circumstances, co-accused Janardan @ Jaldhar Mandal has been
Patna High Court Cr.Misc. No.40038 of 2014 (3) dt.13-02-2015 2/2 granted bail vide Annexure-3. The petitioner has no criminal antecedent.
Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge, NDPS, learned Sessions Judge, Bhagalpur/court concerned in Gopalpur P. S. Case No. 52 of 2013 with following conditions:-
1. The petitioner will not indulge himself in similar or any other offence.
2. One of the bailors must be the close relative of the petitioner.
3. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
