NILU AGRAWAL ORAL ORDER 09-09-2015 Heard learned counsel for the petitioner Sri Mukesh Kumar Singh and learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Chapra Muffasil P. S. Case no. 69 of 2015 for the offence alleged under Sections 457 and 380 of the Indian Penal Code. The prosecution case is that on 28.3.2015 when the informant was in Delhi, theft was committed in her village home and all valuable articles including gas cylinder and ornaments were taken away.
It has been submitted by the learned counsel for the petitioner that he has been falsely implicated in the aforesaid case and nothing incriminating articles have been recovered from the house of the petitioner. It has also been submitted that co-accused Chandan Kumar named in the F.I.R. has already been granted the privilege of anticipatory bail in Cr. Misc. no. 24905 of 2015 vide order dated 14.7.2015. Considering the nature of allegation against the petitioner is similar and stands on the same footing to that of the co-accused, I do not propose to take a different view in this

Under such circumstances, let petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Chapra, Saran in connection with Chapra Muffassil P. S. Case no. 69 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
