Petitioner seeks bail in a case registered for the offence punishable under sections 341, 324, 307, 504 of the Indian Penal Code and Section 37(c) of the Bihar Excise and Prohibition Act.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing incriminating has been recovered from the possession of this petitioner. Petitioner has no criminal antecedent. Petitioner is in custody since 01.04.2019. Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that there is specific

No.68233 of 2019(3) dt.18-11-2019 2/2 allegation of inflicting knife blow against this petitioner which is supported by the injuries sustained, and as such, he does not deserve to be granted the privilege of bail. Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of bail to the petitioner. The prayer for bail is, therefore, rejected.
However, petitioner will be at liberty to renew his prayer for bail after framing of charge.
