2. The petitioner apprehends his arrest in connection with Banubagicha P.S. Case No. 12 of 2025 for the offence registered under sections 137, 140(3) of the BNS.
3. As per the prosecution story, the informant alleged that while his son, Golu was at home, Bhikku Kumar came and later, both went out. However, despite best of effort, the informant failed to locate them, phones being switched off, the FIR.
4. The investigation took place and went to the door of Niraj Kumar and Nitish Kumar and according to them, the accused/deceased (Golu and Bhikku) were in the illegal business of liquor. However, sometimes, the deceased used to

Once they also threatened the accused of dire consequences whereafter, it was planned that Golu is fond of illegal arms and on that pretext, both were taken to a secluded place to show the arms and that gave them an opportunity to open fire killing Golu, while using the stones to kill Bhikku.
5. So far as this petitioner is concerned, he was part and parcel of the crime from the liquor business to the conspiracy to take the deceased to the site where the actual killing took place.
6. The allegation that has come against this petitioner coupled with the fact that he has criminal antecedent, no relief can be extended.
7. Accordingly, the anticipatory bail application stands rejected.
