The present application has been filed for modification of the order dated 16.05.2017 passed in Cr. Misc. No. 52799 of 2016 for extending the period of filing the Matrimonial Suit as well as place of filing of said matrimonial suit. In view of the statement made in paragraph-7 of the memorandum of settlement, the matrimonial suit was to be filed in the Court of learned Principal Judge, Family Court, Patna instead of learned Principal Judge, Family Court, Khagaria, which has already been recorded in order dated 16.05.2017 passed in Cr. Misc. No. 52799 of 2016. Accordingly, place of filing of matrimonial suit be read as learned Principal Judge, Family Court, Patna instead of Khagaria and the period of filing of matrimonial suit is further extended for three weeks.

In the circumstances, the order dated 16.05.2017 passed

Patna High Court Cr.Misc. No.29425 of 2017 (2) dt.05-07-2017 2/2 in Cr. Misc. Case No. 52799 of 2016 is modified to the extent indicated above.

Accordingly, the modification application is disposed of in connection with Complaint Case No. 746C of 2015 pending in the Court of learned Sub-divisional Judicial Magistrate, Khagaria.
