JUSTICE MIHIR KUMAR JHA ORAL ORDER 10-08-2015 Having regard to the fact that the petitioner was holding the post of Anganwari Sevika and her appointment has been cancelled on the ground of having submitted forged mark-sheet, the issue now being sought to be raised by the learned counsel for the petitioner that such finding is incorrect because real marksheet of the petitioner was never sent was/ is capable of being raised before the appellate authority, inasmuch as the Anganwari Guidelines had envisaged an appeal against the order of termination of Anganwari Sevika.

Admittedly the petitioner has not availed the remedy of appeal before rushing to this Court.

Patna High Court CWJC No.12174 of 2015 (2) dt.10-08-2015 This application is, accordingly, permitted to be withdrawn with the liberty to the petitioner to file an appeal before the competent authority, who is expected to go into all the aspects in more detailed manner.
