The petitioners apprehend their arrest in Mansi P.S. Case No. 163/2017, registered for the offence punishable under Section 366(A)/34 of the Indian Penal Code.

The informant had earlier filed a complaint petition alleging therein that her daughter became traceless on 02.05.2017. During course of search, she came to know that Nityanand has enticed her daughter.

Learned counsel for the petitioners submits that the petitioners are father, uncle, mother and aunt of Nityanand. The victim made her statement under Section 164 of the Cr.P.C. and

Patna High Court Cr.Misc. No.43551 of 2017 (2) dt.19-09-2017 2/2 she disclosed that she herself left her house and went to the house of a lady. Nityanand did not kidnap the victim. She did not disclose the name of the petitioners.

Considering the facts aforesaid, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Mansi P.S. Case No. 163/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
