The petitioner seeks anticipatory bail in connection with Barun P.S.Case No. 215 of 2014, registered for offences punishable under Sections 147, 148, 149, 302 , 201 of the Indian Penal Code and 27 of Arms Act.
Allegation against the petitioner is of killing the nephew of the informant by firing and thrown the dead body in Sone river.
Submission of the learned counsel by the petitioner is that the petitioner has committed no such offence and he has falsely been implicated in this case and the name of the petitioner surfaced on the self confessional statement of the petitioner. It is also submitted that three F.I.R. has been lodged against the
Patna High Court Cr.Misc. No.41577 of 2018 (3) dt.03-08-2018 2/2 petitioner on the same occurrence but he has already on bail. Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances as discussed above, the case of the petitioner is concerned, I am not inclined to grant bail to the petitioner, Accordingly, prayer of anticipatory bail is rejected with a direction to the petitioner that if the petitioner surrender before the court below within a period of four weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by this order of this Court and if possible to be disposed of on the same date.
This application is accordingly disposed of.
