2. The petitioner seeks regular bail in a case registered under Section 317(4) of B.N.S. & 30(a) of Bihar Prohibition and Excise Act.
3. As per the prosecution case, 198 liters of illicit country made liquor has been recovered from the auto at Islamia Chowk. Petitioner and other co-accused were apprehended on the spot.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Nothing has been recovered from conscious possession of the petitioner. Neither alleged illegal liquor and seized Auto belongs to the petitioner. The petitioner has no concern with the
Patna High Court CR. MISC. No.58137 of 2025(2) dt.04-09-2025 2/2 seized liquor. Petitioner was unware about keeping of illicit liquor in the seized Auto. The petitioner is in jail custody since 22.06.2025 having clean antecedent. The petitioner undertakes to cooperate in the investigation and trial.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 03, East Champaran at Motihari in connection with Dhaka P.S.
