The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Section 414/ 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner has antecedent of one case and the informant alleges that he received secret information while on patrolling and accordingly, went in search of the accused persons about whom information was given as detailed in the F.I.R. It is next alleged that three accused persons were arrested, who disclosed the name of Seraj Hussain and Rohit Kumar Tiwary as member of the gang, accordingly, the police arrested Seraj Hussain and Rohit Kumar Tiwary also, who further disclosed the name of

Patna High Court CR. MISC. No.69120 of 2021(2) dt.26-07-2022 2/3 eight accused persons including the petitioner suggesting that the petitioner is also in the gang and they were planning to loot a petrol pump.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated because of his antecedent. It is next submitted that initially the accused persons, who were apprehended did not disclose the name of the petitioner and it was Seraj Hussain and Rohit Kumar Tiwary, who disclosed about the petitioner before the police. It is submitted that had the petitioner been member of the gang, then the three accused who were arrested earlier, would have taken the name of the petitioner.

The learned Additional Public Prosecutor opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Baikunthpur P. S.

Patna High Court CR. MISC. No.69120 of 2021(2) dt.26-07-2022 3/3 Case No.399 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C., subject to condition that one of the bailors of the petitioner shall be his father namely, Prabhu Singh.

The application stands allowed.
