The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 363, 367 of the Indian Penal Code.

The F.I.R. would reveal that son of the informant had some affairs with Khushbu, the daughter of Bindeshwari Manal. The aforesaid fact has been admitted by the son of the informant aged about 18 years.

The allegation is of kidnapping of the son of the informant by the petitioners and others for the purpose of solemnization of his marriage with Khushbu.

Submission of learned counsel for the petitioners is

Patna High Court Cr.Misc. No.52003 of 2018(3) dt.29-11-2018 2/2 that kidnapping is a simplicitor bailable offence and kidnapping of a male for marriage purpose is no offence. Hence, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Tikapatti Police Station Case No.97 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioners.
