The petitioner seeks pre-arrest bail in connection with Shakurabad P. S. Case No. 19 of 2017 registered under Section 414/34 of the Indian Penal Code.
It is submitted that a Hero Honda motorcycle was recovered from a room of the house of Moti Singh and apparently, the same appears to be stolen one, but there is no positive evidence that the vehicle was stolen. It is submitted that so far as the petitioner is concerned, he is the son of Moti Singh and has nothing to do with the alleged recovered motorcycle. It is further submitted that Moti Singh has also been made accused
Patna High Court Cr.Misc. No.21017 of 2017 (2) dt.06-07-2017 2/2 in this case and even the seizure-list would disclose that recovery was made from the house of Moti Singh. Considering the submissions made above and also the statement made in para-3 of the bail application that the petitioner has got no criminal antecedent, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-I, Jehanabad in Shakurabad P. S. Case No. 19 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
