The petitioner seeks bail in Special (NDPS) Case No. 153 of 2021, arising out of Shastrinagar P.S. Case No. 510 of 2021, registered for the offence under Section 411, 413, 414/34 of the Indian Penal Code and Sections 8(c), 21(b), 27 of the NDPS Act.

As per the prosecution case, this petitioner was apprehended with other co-accused persons with the allegation that he was involved alongwith other accused persons in committing theft.

It is submitted on behalf of petitioner that neither any stolen article nor any narcotic substance has been recovered from the possession of the petitioner and he has been made accused only because he was apprehended with other accused

Patna High Court CR. MISC. No.68450 of 2021(2) dt.03-03-2022 2/2 persons. Recovery of alleged Smack has been effected from the possession of co-accused Chandan Kumar. Petitioner is in custody since 20.10.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Patna in connection with Special (NDPS) Case No. 153 of 2021, arising out of Shastrinagar P.S.
