====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 19-01-2024 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

2. Petitioner apprehends his arrest in connection with Hajipur Sadar P.S. Case No. 896 of 2022 dated 05.11.2022, registered for the offence punishable u/s 393, 307 of the I.P.C. and Section 27 of the Arms Act, pending in the court of learned Chief Judicial Magistrate, Vaishali at Hajipur.

3. As per the F.I.R., the allegation against the petitioner is that he along with other co-accused have snatched the bike of the informant.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has been falsely implicated in this case due to previous grudge. The allegations levelled against the petitioner is general and omnibus in nature. The

Patna High Court CR. MISC. No.59129 of 2023(4) dt.19-01-2024 2/2 name of the petitioner has transpired on confessional statement of co-accused, Bittu Kumar. Petitioner has three criminal antecedent as mentioned in para 3 of the bail application.

Per contra, learned APP for the State vehemently opposed the bail petition and submitted that petitioner has involved in the present case, it is evident from the evidence recorded by the police in the case diary. He further submitted that the allegations levelled against the petitioners is serious in nature, hence he does not deserve the anticipatory bail.

6. Considering the facts and circumstances of case, the nature of offence and criminal antecedent of the petitioner, I am not inclined to enlarge the petitioner on bail. The prayer for bail of the petitioner is hereby rejected.
