====================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL ORDER 26-11-2016 Heard learned counsel for the parties. The petitioner seeks bail in connection with Wazirganj P.S. Case No. 425 of 2013 dated 09.09.2013 instituted under Sections 302/34 of the Indian Penal Code and 27 of The Arms Act, 1959.
This is the second attempt of the petitioner for bail in connection with Wazirganj P.S. Case No. 425 of 2013 as earlier such prayer was rejected by order dated 12.12.2014 in Cr. Misc. No. 16821 of 2014. However, the Court below was directed to expedite the trial and conclude the same within six months.
Earlier, pursuant to report called for from the
Patna High Court Cr.Misc. No.37883 of 2015 (3) dt.26-11-2016 2/2 Court below, with regard to the status of the case, letter no. 154 dated 08.11.2016, has been received from the Additional District and Sessions Judge-V, Gaya stating that earlier the order of the Court was not brought to his notice and he has prayed for six months time to conclude the trial.
As no fresh ground has been shown on behalf of the petitioner after the earlier rejection order, the Court is not inclined to enlarge the petitioner on bail. Accordingly, the application stands dismissed.
However, the Court below is directed to ensure that the case is concluded by 31st March, 2017 positively, failing which the Court shall be constrained to take strict judicial notice.
Registry shall communicate the order to the Court below as well as to the Superintendent of Police, Gaya by Fax also latest by 29th November, 2016, who shall ensure production of the prosecution witnesses on the dates fixed by the Court.
