JUSTICE RAVI RANJAN ORAL ORDER 25-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offences punishable under Section 392 of the Indian Penal Code and Sections 25 (1-b) a, 26 and 35 of the Arms Act. It is contended on behalf of the petitioner that he has not been named in the First Information Report. He has been implicated on the basis of self incriminating confessional statements of co-accused persons, namely, Md. Anjar and Sarfaraz. The petitioner claims that his antecedent is clean and he is in custody since 21.07.2016.
Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief
Patna High Court Cr.Misc. No.45697 of 2016 (2) dt.25-10-2016 2/2 Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No.430 of 2016 with a condition that one of the bailors must be the father of the petitioner.
However, at the time of accepting bail bond, the court below would verify and assure itself regarding the criminal antecedent of the petitioner. If he is having clean antecedent then his bail bond would be accepted. If he is found to be involved in any other case before 28.09.2016 then he would not be released. (Dr. Ravi Ranjan, J) V.K.
