Petitioners are named in the first information report but the first information report goes to show that alleged occurrence took place on account of land dispute. Moreover, there is general allegation of assault against these petitioners.
Initially, present case was lodged under section 307 and other minor sections of the Indian Penal Code but near about after nine days of the occurrence injured Arun Sharma died in course of his treatment and thereafter, section 302 of the Indian Penal Code was also added. Witnesses, in course of investigation, stated that it was coaccused Naresh Sharma who gave lathi blow causing head injury to the deceased. So far as rest injured are concerned, they sustained

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of Sri Amit Anand, Judicial Magistrate, Ist Class, Begusarai/ concerned court in Birpur P.S. Case no. 40/2016.
