I have heard the learned counsel appearing on behalf of the State. The petitioner seeks quashing of the FIR of Mojahidpur (Babargunj) P.S.Case No.36 of 2011 under Sections 406,467,420 and 120B Indian Penal Code.

On considering the written report addressed to the Deputy Inspector General of Police, Bhagalpur what appears to this Court is that the facts stated do constitute same cognizable offence which divest this Court from entertaining this petition because the police has the statutory power to investigate the case and no Court could scuttle it out.

Petition lacks merit and the same is dismissed. (Dharnidhar Jha, J) B.Kr./-Saif.
