2. The accused/petitioner seeks bail in connection with Siwaipatti P.S. Case No. 117 of 2024 registered for the offences under Sections 63(a)(b), 64(1), 333, 351(2), 351(3) of the Bhartiya Nyay Sanhita, 2023 (in short, the 'B.N.S.') and 66 of the I.T. Act.

3. The accused/petitioner is named in the First Information Report and is in custody since 30.05.2025.

4. Allegation against the petitioner is to commit rape upon the informant aged about 32 years and a married lady on the pretext of threat to make her video viral on social media platform.

5. It is submitted by learned counsel appearing on behalf of the petitioner that due to certain monetary dispute, the present false case was raised by the informant upon instigation of her husband, who even after this case implicated the family members through Complaint Case No. 3807/2025. It is submitted that the victim refused to join medical examination.

6. While concluding argument, it is submitted that petitioner found involved in two more criminal case of trivial nature, in which he is on bail and, moreover, investigation of this case is already concluded and as such, there is no chance of tampering with the evidence.

7. Learned A.P.P. for the State has opposed the prayer for bail of the petitioner.

8. In view of aforesaid factual submission and by taking note of the background in which the present allegation appears raised, coupled with the fact that investigation of this case is already completed, where petitioner remains in custody since 30.05.2025, accordingly, above-named petitioner is directed to be released on bail, furnishing bail

Patna High Court CR. MISC. No.56685 of 2025(3) dt.18-11-2025 3/3 bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. (East), Muzaffarpur/concerned court, in connection with Siwaipatti P.S. Case No. 117 of 2024, subject to the condition as laid down under Section 437(3) Cr.P.C/Section 480(3) of the Bhartiya Nagarik Suraksha Sanhita (in short "B.N.S.S.").
