The petitioner is apprehending his arrest in connection with Nabinagar Police Station Case No.137 of 2018 registered for the offences punishable under Sections 401 and 420 of the Indian Penal Code.

Allegation against the petitioner is that he was a Cashier in the Bank. He received cash amount of Rs.2,06,000/- (Rupees Two Lacs and Six Thousand) from a customer namely, Anil Kumar Singh on 16.10.2017 for deposit of the said amount in the loan account of Anil Kumar Singh. The petitioner did not deposit the said amount, rather deposited the amount in piece mill manner from 03.11.2017 to 07.11.2017 in the Bank

Patna High Court Cr.Misc. No.51753 of 2018(3) dt.26-11-2018 2/2 account. The petitioner did not submit the day to day account of the aforesaid money to the Manager. Therefore, there is no explanation that due to inadvertence the money was not deposited is not acceptable.

The people have great confidence on the Cashier of the Bank, who have no confidence on the customers. First the people hand over the entire money, including in crores to be deposited in the Bank and thereafter, the Cashier counts the same and thereafter, after counting gives the receipt, even to those customers who are well known to the Bank. If, such persons are allowed to handle the cash counter, the confidence of the people would erode from the entire system. The petitioner is already under suspension.

Considering the nature of allegation, I am not inclined to enlarge the petitioner, above named, on anticipatory bail. Hence, prayer is refused.
