Petitioner is apprehending his arrest in connection with Gaya District Forest Case No. 152 of 2007-08 arising out of Forest Case No. 19/2008 for the offence under Section 33 of the Indian Forest Act.

Considering the fact that the alleged occurrence took place in the year 2007 and prosecution report was sent to the Court in 2008 and the similarly circumstanced co-accused having similar allegation has been granted anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 16311 of 2018 vide order dated 30.04.2018, this Court is inclined to grant bail in favour of the petitioner.

No.62460 of 2018(4) dt.12-12-2018 2/2 In the event of arrest or surrender before the court below within a period of one month from today, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Sherghati at Gaya in connection with Gaya District Forest Case No. 152 of 2007-08 arising out of Forest Case No. 19 of 2008 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
