JUSTICE ARUN KUMAR JHA ORAL ORDER 13-12-2023 At the request of learned counsel for opposite party no. 2, the matter was referred for mediation and the report of learned Mediator has been received, wherein it has been submitted that dispute between the parties has been resolved through the process of mediation on mutually agreed terms and the terms of the settlement has been annexed with the report.

2. In terms of the settlement, both the parties have agreed to close all the pending cases with mutual consent and have agreed to get their marriage dissolved.

3. As per prosecution case, allegation against the petitioner is that of demand of dowry and torturing the informant with cruelty.

4. In light of the settlement between the parties, let the petitioner above named, in the event of his arrest or surrender before the court concerned within a period of eight weeks from today, be released on bail, on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali/court concerned in connection with Vaishali P.S. Case No. 232 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
