The petitioner being the husband of the complainant is languishing in custody since 03.09.2016 in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under sections 498A, 323, 504 and 506 of the Indian Penal Code. Basic accusation is of torture. Prosecution case is that the complainant got married with the petitioner on 25.05.2015, but on the date of marriage the petitioner in inebriated condition ravished the complainant and thereafter further dowry demand of rupees fifty thousand and motorcycle was made.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.45674 of 2016 (2) dt.25-10-2016 2/2 petitioner admits his marriage with the complainant and he is ready to keep the complainant as wife with full dignity and honour. A statement to that effect has been made in para 8 of the petition which reads as follows:- "That the petitioner is always ready to keep his wife with full dignity and honour..."

Considering the nature of accusation and present stand of the petitioner, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Banka, in connection with Complaint Case No.916/2015.
