JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and learned APP representing the State.

The petitioner apprehends his arrest in connection with Ram Krishna Nagar P.S. Case No. 188 of 2015 registered for the offences punishable under Sections 341, 323, 379, 504/34 of the Indian Penal Code.

There is allegation against the petitioner to have assaulted the informant with iron rod on head and further to have snatched gold chain from the neck of the informant.

Submission is of false implication and that the petitioner has also sustained injury, there is case and counter case, after completion of investigation chargesheet has been submitted under Sections 341, 323, 504/34 IPC only vide Chargesheet No. 242/16 but cognizance has been taken under Section 379 IPC also and as such the petitioner is apprehending his arrest.

Patna High Court Cr.Misc. No.35159 of 2017 (2) dt.10-08-2017 Learned APP fairly submits that chargesheet has been submitted under sections 341, 323 and 504 IPC. In the facts and circumstances stated above, the petitioner above named, in case of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge XIII-cum-ACJM, Patna in connection with Ram Krishna Nagar P.S. Case No. 188 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
