2. The petitioner by invoking the jurisdiction of this Court seeking quashing of the General Notice contained in Memo No. 1182, dated 02.08.2024 issued under the signature of Circle Officer, Barahat, District-Banka by which he has invited

Patna High Court CWJC No.13556 of 2024(2) dt.09-09-2024 2/3 objection to all concern in relation to the lands of Khata No. 34, Plot No. 7, 26, 100, 115, 133, 135, 140, 130 and 155 situated in village-Kolhatha, Thana No. 129, Anchal- Barahat, DistrictBanka till 12.08.2024.

3. While assailing the impugned notice and seeking consequential relief, various averments have been made in the writ petition in support of the claim of the petitioner. However, the petitioner has failed to persuade this Court as to what has prevented the petitioner to approach before the Circle Officer and bringing on record all such facts as have been stated in this writ petition.

4. Learned Advocate for the State also contended before this Court that by the notice impugned, objection has been invited and the petitioner is under obligation to place all the facts before the Circle Officer; who shall consider the same and pass necessary order.

5. Considering the grievance of the petitioner, this Court finds substance in the contention of the learned Advocate for the State; accordingly, the present writ petition stands disposed of with a liberty to the petitioner to file a proper objection/reply before the Circle Officer within a period of two weeks from today.

6. If such an objection/reply is filed within the stipulated period, the same shall be considered and disposed off in accordance with law preferably within a further period of eight weeks thereafter.
