JUSTICE SANJAY KUMAR ORAL ORDER 21-08-2017 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Industrial Area P.S. Case No. 92 of 2017 instituted for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 382 and 379 of the Indian Penal Code.

The allegation as per written report is that the accused persons including this petitioner intercepted the informant and thrashed him and they tried to flee away after snatching his mobile phone. In the meanwhile, the police came and apprehended two of the accused persons, who disclosed the name of the petitioner.

Nothing incriminating has been recovered from the apprehended accused persons. The name of this petitioner surfaced in the alleged confession of the said co-accused before the police. The matter has been compromised and the compromise petition has been filed before the court below. There is no criminal antecedent against the petitioner.

The learned A.P.P. for the State opposed the submission.

In the aforesaid facts and circumstances of the case, the anticipatory bail prayer is allowed. The petitioner, above named, in the event of arrest / surrender within six weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Vaishali at Hajipur, in connection with Industrial Area P.S. Case No. 92 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
