The petitioner apprehends his arrest in a case under section 420 of the Indian Penal Code and section 138 of N.I. Act. The complainant alleged that the petitioner borrowed rupees five lacs from him and handed over two cheques, but both the cheques were dishonoured on being presented. It is submitted that the petitioner never borrowed any money. The cheques of the petitioner were lost, and for that the petitioner filed informatory application.
Considering the aforesaid facts and the fact that the case
Patna High Court Cr.Misc. No.40869 of 2014 (2) dt.01-04-2015 2 / 2 relates to borrowing and lending of money, it is directed that in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, the above named petitioner shall be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Patna City in connection with Complaint Case No. 1353(c) of 2013, subject to the conditions as laid down under section 438(2) Cr.P.C.
