JUSTICE SUDHIR SINGH ORAL ORDER 09-10-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered under Section-7 of Essential Commodities Act. The allegation against the petitioner is that he has not supplied 3900 litres of K. oil to Khagaria Jail and he misappropriated the same for black market.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is ready to deposit an amount of Rs. 60,000/- (sixty thousand) in the court below subject to final outcome of the case.

Patna High Court Cr.Misc. No.53647 of 2018 (3) dt.09-10-2018 On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, on deposit of Rs. 60,000/- in the court below subject to final outcome of the case, let the petitioner named above in the event of arrest/surrender within six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Khagaria in connection with Khagaria (Muffasil) P.S. Case No. 491 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) A.K.V./- U T
