Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in a case registered for the offences punishable under Sections 392/34 of the Indian Penal Code read with Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 11.06.2021, charge-sheet has been submitted and has antecedent of four cases.
Allegation is of looting the tractor and Rs.10,000/- of the informant on the gun point by four unknown miscreants. Learned counsel for the petitioner submits that the FIR was against unknown and the name of the petitioner transpired in the confessional statement of co-accused Dinesh Chauhan and despite being in custody he was not put on T.I. Parade nor any incriminating
Patna High Court CR. MISC. No.68677 of 2021(2) dt.10-05-2022 2/2 article has been recovered from the possession of the petitioner. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner and submits that petitioner has antecedent of four cases and he may abscond in the event of his release.
Considering the fact that the petitioner is in custody since 11.06.2021, charge-sheet has been submitted, name of the petitioner transpired in the confessional statement of co-accused and was not put on T.I. Parade nor any incriminating article was recovered from the possession of the petitioner, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.Tr. No. 230 of 2021 arising out of Kudhani P.S. Case No. 19 of 2018, subject to the condition that one of the bailors of the petitioner shall be the mother Sema Devi. The petitioner shall be released after framing of charge. In the event, if the charges have been framed, the petitioner shall be released forthwith.
