ANJANA MISHRA ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner being mother-in-law apprehends her arrest in connection with Ladaniya P.S. Case No. 140/2015 registered for the offences punishable under Sections 341/324/307/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. Subsequently, Section 304(B) of the Indian Penal Code was added.

Learned counsel for the petitioner submits that there is no specific allegation against the petitioner, but after perusal of the First Information Report, it appears that the victim lady, during the course of her treatment, herself made a statement in hospital that her mother-in-law Chandar Devi @ Chandra Devi had poured kerosene oil over her shoulder and thereafter her husband had set her ablaze.

Patna High Court Cr.Misc. No.47124 of 2016 (2) dt.24-11-2016 P2/2 In view of such statement made by the victim lady, I am not inclined to grant anticipatory bail to this petitioner. It is accordingly rejected.
