KUMAR ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 23-11-2020 Petitioner has prayed for the following relief(s): 1(i) Issuance of a direction, order or writ, including writ in the nature of mandamus commanding the concerned respondent authorities under the Urban Development Department of the Sate Government and also the concerned authorities under the Patna Municipal Corporation, Patna to take steps towards removing the garbage bins lying in the middle of the Northern Boring Canal Road in front of Hotel Siddharth Inn and further to take steps towards removal of the garbage and rubbish lying in the middle of the road, which is a constant threat to the ongoing traffic on both

Patna High Court CWJC No.17169 of 2014 dt.23-11-2020 2/3 the sides Northern Boring Canal Road and furthermore poses a serious threat to the health and hygiene of the residents of the locality; (ii) Issuance of a direction, order or writ, including writ in the nature of mandamus commanding the concerned respondent authorities under the Urban Development Department of the State Government and also the Patna Municipal Corporation, Patna to take steps towards developing the area, in question in a similar manner as has been done in the said parts on different portions of the Boring Canal Road by way of building a parking lot or creating a green patch;

(iii) Any other relief/reliefs that the petitioner may be found to be entitled to in the facts and circumstances of the present case."

The instant petition was directed to be listed along with C.W.J.C. No. 12649 of 2015 titled as Mukesh Kumar Vs. The State of Bihar & Ors. which stands withdrawn today [23.11.2020].

Shri Abhinav Srivastava, learned counsel for the petitioner states that the present petition be disposed of on the very same terms of the order passed today in C.W.J.C. No. 12649 of 2015 titled as Mukesh Kumar Vs. The State of Bihar & Ors.

Patna High Court CWJC No.17169 of 2014 dt.23-11-2020 3/3 Accordingly, the present petition stands disposed of on the very same terms of the order passed today in C.W.J.C. No. 12649 of 2015 titled as Mukesh Kumar Vs. The State of Bihr & Ors. Directions issued therein shall apply mutatis mutandi also to the instant case.
