JUSTICE SUDHIR SINGH ORAL ORDER 18-10-2016 Supplementary affidavit has been filed on behalf of the petitioner. The same may be kept on the record. Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case instituted under Section 395 of the Indian Penal Code.

The prosecution story in brief, is that while the informant was going on his motorcycle, in the meantime, some unknown miscreants on the point of pistol, looted Rs. 300/-, which was kept in his pocket of the informant along with one mobile set.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.03.2016. The charge sheet has

Patna High Court Cr.Misc. No.44345 of 2016 (2) dt.18-10-2016 2/2 been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the First Information Report. He has not been put on Test Identification Parade. No incriminating article is said to have been recovered from the possession of the petitioner. On behalf of the state, it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saharsa, in connection with Sonbarsa Raj (Kash Nagar O.P.) P.S. Case No. 206 of 2015.
