The petitioner seeks regular bail in connection with Musahari P.S. Case No.96 of 2025 registered for the offence under sections 103(1)/3(5) of the B.N.S., 2023 and under section 27 of the Arms Act.

The petitioner is accused of killing the nephew of the informant. He is in custody since 15.05.2025. 4.

Learned counsel for the petitioner submits that the petitioner is innocent and has been implicated in this case only on the basis of suspicion.

Learned counsel for the informant has vehemently opposed the prayer of the petitioner for grant of bail.

From the F.I.R. it appears that one Anshu

Patna High Court CR. MISC. No.56658 of 2025(3) dt.17-10-2025 2/2 Kumar, who is the brother of the petitioner, is the assailant of the deceased.

Considering the aforesaid fact and also the period of custody of the petitioner, this application is allowed. 8.

Let the petitioner, above named, be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Court No.12, Muzaffarpur (East) / concerned Court below, in connection with Musahari P.S. Case No.96 of 2025, subject to the condition that he will cooperate in the trial and will appear himself or through his lawyer on the dates fixed in the trial. 9.

The informant may approach the Senior Superintendent of Police, Muzaffarpur for protection of witness(s) under the Witness Protection Scheme by filing an application. If such an application is filed, the Senior Superintendent of Police, Muzaffarpur, will take steps to protect the witness(s) of the case in accordance with law. (Sandeep Kumar, J) pawan/- U T
