Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B), 201/34 of the Indian Penal Code.

Petitioner happens to be husband of the deceased and it is alleged that deceased was subjected to cruelty and harassment soon before her death due to non fulfilment of dowry demand and subsequently, she was burnt to death by the petitioner and other accused. The marriage of deceased had taken place with petitioner three years back.

Patna High Court Cr.Misc. No.46506 of 2016 (4) dt.08-12-2016 2/2 Learned counsel appearing for the petitioner submits that as a matter of fact, deceased died of natural death and her cremation was performed in presence of the informant but later on, informant started demanding cash, land and ornaments of deceased which was refused by the petitioner resulting institution of the present case.

Regard being had to the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail, at least, at this stage and hence, his prayer for bail in connection with Hilsa P.S. Case No. 216 of 2016 pending in the court of Additional Chief Judicial Magistrate-II, Hilsa, Nalanda stands rejected. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
