JUSTICE SHIVAJI PANDEY ORAL ORDER 20-07-2017 Heard learned counsel for the petitioners and learned counsel for the State.

In this case, the petitioners are seeking anticipatory bail in connection with Narhat P.S. Case No.64 of 2016, registered for the offence punishable under Sections 353 and 307/34 of the Indian Penal Code.

As per the F.I.R, when the Panchayat election was going on, information was received that certain persons were disturbing the polling process. The Police party reached there and found two groups of persons were scuffling to each other and disturbing the polling process.

No.32227 of 2017 (2) dt.20-07-2017 2/2 Learned counsel for the petitioners submits that in the present case, the petitioners were not named in the F.I.R. but all those who were accused in Narhat (Sitamarhi) P.S. Case No.60 of 2016 and in that case they have been granted bail. Looking to the aforesaid facts and circumstances of the case, let the above-named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Nawada, in connection with Narhat P.S. Case No.64 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
