====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-05-2023 This is an application for grant of anticipatory bail in connection with Kahalgaon P.S. Case No. 577 of 2022, registered for the offence punishable under Section 498A/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
At the outset, the learned counsel for the petitioner, Sri Dr. Manoj Kumar and the learned counsel for the informant, namely, Kshem Sharma, in presence of the learned APP for the State, have jointly submitted that the matter has already been compromised and settled in between the parties and good relationship has been restored between them, hence, they do not want to pursue the present case any further and to the said
Patna High Court CR. MISC. No.57337 of 2022(4) dt.22-05-2023 2/2 effect, a compromise petition dated 6.4.2023 has been produced, which is taken on record.
In view of the joint submissions made by the learned counsel for the petitioner and the informant, I deem it fit and proper to admit the petitioner to the privilege of anticipatory bail.
Accordingly, the petitioner is directed to be enlarged on anticipatory bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Kahalgaon P.S.Case No. 577 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
