06-10-2018 Heard Sri Pramod Kumar Singh, learned counsel for the petitioner and Sri Tarun Prasad Mandal, learned Addl. Public Prosecutor.
The sole petitioner, apprehending his arrest in Sarairanjan P.S. Case No. 92 of 2018 registered for offence under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 38(2) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender. It was submitted by learned counsel for the petitioner that in this case, petitioner has been made accused on the basis of confessional statement of co-accused. He further submits that after the petitioner was made accused in the present case, again falsely petitioner has been made accused in another case i.e. Sarairanjan P.S. Case No. 100 of 2018.
Patna High Court Cr.Misc. No.53629 of 2018(3) dt.06-10-2018 2/2 Considering the nature of accusation as well as the fact that petitioner has been made accused on the basis of confessional statement of co-accused, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Randhir Mahto be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge 6th cum Special Judge, Excise Act, Samastipur, District - Samastipur in connection with Sarairanjan P.S. Case No. 92 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
