Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners seek regular bail in connection with Jadopur P.S. Case No. 154 of 2022 lodged under Sections 414 of the I.P.C. read with Section 30(a) of Bihar Prohibition and Excise Act, 2018.

As per the prosecution case, the total recovery of 98.82 liter of foreign liquor has been made, which is subject matter of the present case.

Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.57353 of 2022(3) dt.08-12-2022 2/2 petitioners' antecedent are clean and they are in custody since 30.08.2022. Learned counsel submits that the alleged recovery has been made from a vehicle in which the petitioners were coming from Thawe Mandir and the police asked them to be a witness of the said seizure, upon refusal the police has put their names in this case. Learned counsel further submits that they are ready to fulfill all the conditions whatsoever shall be imposed upon them.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioners above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge II-cumSpecial Judge Excise-I, Gopalganj in connection with Jadopur P.S. Case No. 154 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
