The petitioner seeks bail in a case registered under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that the accused persons shot down the brother of the informant which he was coming from market. It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.06.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The main allegation of assault is against co-accused Kari Singh. So far petitioner is concerned, no allegation of assault is alleged against him. He is

Patna High Court CR. MISC. No.54345 of 2019(2) dt.30-08-2019 2/2 a member of unlawful assembly. Other co-accused has been granted bail vide Cr.Misc.No.46216 of 2019.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Muffasil P.S. case NO.163 of 2019.
