The petitioner apprehends his arrest in Complaint Case No.25 of 2018 for the offences allegedly committed by the petitioner under Section 498A of the Indian Penal Code and under Section 4 of the D.P. Act.

The complainant made allegation of demand of additional dowry and torture against the petitioner. Learned counsel for the petitioner submits that the petitioner is ready to keep his wife. The petitioner filed Matrimonial Case No.207 of 2017 for restitution of conjugal rights but the complainant herself refused to accompany the

Patna High Court CR. MISC. No.54512 of 2019(2) dt.30-08-2019 2/2 petitioner and after filing of matrimonial case, the complainant filed the present case.

Having considered the facts that the petitioner is willing to keep his wife (complainant) but the complainant herself does not want to live with the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Rohtas at Sasaram in connection with Complaint Case No.25 of 2018 subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
