The petitioner has preferred this application for grant of regular bail in a case registered under sections 395, 397 of the Indian Penal Code to which sections 400, 412, 414, 427 of the Indian Penal Code were added subsequently.

As per the prosecution case, 3 accused persons committed bank dacoity and took away Rs. 2,61,600/- in cash. It is submitted by learned counsel for the petitioner that the FIR was registered against three unknown. The name of the petitioner transpired in course of investigation in the confessional statement of co-accused Subhash Thakur, who has himself being enlarged on bail vide order dated 24.02.2021 (Annexure-2). It is alleged that Rs. 3,000/- was recovered from the possession of the petitioner, however, contrary to the allegations, the same was not

Patna High Court CR. MISC. No.68556 of 2021(2) dt.17-05-2022 2/2 recovered in the envelope of the bank. The petitioner has not been put on T.I. Parade. He is in custody since 27.04.2020 and investigation in the case has concluded. Co-accused, Arjun Paswan whose name also transpired in the confessional statement of Subhash Thakur has been enlarged on bail vide order dated 07.10.2021 (Annexure-3).

Having heard learned counsel for the parities and taking into consideration the materials on record, grant of bail to coaccused, Subhash Thakur, on whose confessional statement the name of the petitioner transpired and the petitioner not having been put on T.I. Parade in spite of being in custody for one year, the petitioner above-named, is directed to be enlarged on bail in connection with S.T. No. 244 of 2021, arising out of Muzaffarpur Sadar P.S. Case No. 218 of 2020 on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-X, Muzaffarpur.
